Krishna Kirti Das According to CC the standard is any semblance of improprety. Damodara Pandita forbade the Lord from playing with a young boy because his mother was a young abd beautiful widow. And Caitanya Mahaprabhu’s rejection of Chhotta Haridas was on account of what is by today’s standards something hardly thought of as a falldown. I other words, semblance of impropriety is tantamount to impropriety. That is, where there is smoke there is fire. That is how Mahaprabhu dealt with such matters.As BG Prabhu has pointed out, P Swami and others are guided by sentiment, and they seem to have little patience for shastric discussion. Unfortunately, that leaves almost no other avenue of getting the point across other than the maha bashing Hanuman Prabhu is unleashing on them. (And a big thank you to Hanuman Prabhu for doing so.)

I would suggest adding some of these more philosophical points in with the verbal dandas, as it will make it difficult for them to say that you are just unhinged.

If they respond about some SP anecdote (SP did like this, not like CMP), then we start getting to the heart of their thinking on the matter, and that is where you want to deliver the heaviest philosophical points and strong words.

However, that may or may not be an absolutely “water tight” case “in and of itself” that SNS is living with her. Sure, the article alleges so many things. You now need testimony from various devotees that the two are actually residing together. As I wrote you privately, I was told this during my few days in Berlin back during the summer of 2012. There are probably a number of devotees who can testify — in writing — that such is the case (unfortunately, since I consider SNS a “friend” — but am not in touch with him at all — he’s never visited Gujarat, as I recall). I have no animosity towards him whatsoever. But if this lady lives in his compound — as I was told — for the past many years, well, yes, it is inappropriate for a sannyasi. The thing is that SNS is a very kind and gentle person, and so he is well liked. Thus, simply allegation won’t work here. You need facts. And written testimony by a number of witness, to prove the charges, and then only will Prahladananda Maharaj can act — otherwise he will be criticized himself for acting without proof. He is in a “catch 22” situation. He may have seen the article on the Sun website, but possibly feels that there is not enough tangible proof to substantiate the allegations. It must be seen that justice is done for all, including for SNS.

Some points…

 

The Swami has a female secretary (this is not too dangerous; after all it is just weakness of the senses not a philosophical deviation.)
The Swami makes submissive inquiries to Ramesh Baba the guru-less Sahajiya-Mayavadi (this is most dangerous because the Swami has lost the sense of discrimination, sat asat viveka buddhi which discriminates as to who is a vaishnava and who is a mayavadi)
Ramesh baba would have been kicked on the face if SP was here.
Which sannyassi disciple of SP when SP was present ever took instructions a mayavadi even for 10 minutes?
Which sannyassi disciple of SP when SP was present ever discussed Radharani-katha with a mayavadi even for 10 minutes?
Firstly, he is talking loosely about Radharani and then insult to injury- he is talking loosely about Radharani with Ramesh Baba and taking instructions from Ramesh Baba. Even if you argue that it is not classified as ‘loose talking’, still it is being done with Ramesh Baba.

Logic dictates that Sacinandana Swami

A Swami with too many loose talks about Radharani
A Swami who gives meditation techniques to Pandava Sena
A Swami who does not give Pandava Sena instructions on avoiding free mixing (this is an independent report)
A Swami who does not give instruction to the Pandava Sena on premarital illicit affairs (this is an independent report)
A Swami who has discussions about Radharani with a mayavadi- Ramesh baba
A Swami who takes philosophical instructions from a mayavadi- Ramesh baba (as opposed to taking general practical instructions on working a computer, exercising, improving health, local Vrindavan politics etc)

Has something ill about his character and intentions. It raises too many red flags.

What would SP have said and done if SP saw his female-secretary-having-sannyassi discussing Radharani with a mayavadi and or taking instructions from a mayavadi like Ramesh Baba? I will leave the conclusion to you.

It is to be further noted that Sacinandana Swami just by chance happens to find a young attractive girl who is qualified to be his secretary. No ugly old fat bhaktins around?

Ramesh Baba has no guru coming from the four bonafide sampradayas. End of argument.

Thus he is unfit to take spiritual instructions from or hear Harinaam from.

avaiṣṇava-mukhodgīrṇaṁ pūtaṁ hari-kathāmṛtam śravaṇaṁ naiva kartavyaṁ sarpocchiṣṭaṁ yathā payaḥ (Padma Purāṇa)

SB 6.17.40, Purport:

Anything about devotional service or the characteristics of the Lord and His devotees must be heard from a devotee, not from a professional reciter. This is advised herein. Śrī Caitanya Mahāprabhu’s secretary also advised that one learn the history of Śrīmad-Bhāgavatam from a devotee: yāha, bhāgavata pada vaiṣṇavera sthāne. One should not hear the statements of Śrīmad-Bhāgavatam from professional reciters, or else they will not be effective. Quoting from Padma Purāṇa, Śrī Sanātana Gosvāmī has strictly forbidden us to hear about the activities of the Lord and His devotees from the mouths of nondevotees:

avaiṣṇava-mukhodgīrṇaṁ
pūtaṁ hari-kathāmṛtam
śravaṇaṁ naiva kartavyaṁ
sarpocchiṣṭaṁ yathā payaḥ

“One should not hear anything about Kṛṣṇa from a non-Vaiṣṇava. Milk touched by the lips of a serpent has poisonous effects; similarly, talks about Kṛṣṇa given by a non-Vaiṣṇava are also poisonous.” One must be a bona fide devotee, and then he can preach and impress devotional service upon his listeners.

Even if tomorrow he comes out and apologies for his mayavadi words still he is a person who no one in existence should associate with for spiritual benefits.
We can speak with him on many practical matters just as we may discuss with an real estate agent or a politician or a plumber helping us in the holy lands but not on spiritual matters.
Why can’t we get these simple facts in our heads?
When iskcon members fail to grasp these essential and easy to understand points
then we have a regretful recourse – to agree with Hridayananda Maharaja when he calls them morons since that is exactly what they are.
All glories to the misapplied intelligence of Hridayananda Maharaja!
It’s not that Sacinandana Swami et al are going to the sahajiya-cum-mayavadi to educate him in the teachings of Prabhupada. That would have been the best thing.
We don’t want to avoid giving association to mayavdis. We want to avoid taking their association.
We don’t want to reject mayavadis when they make submissive inquires.
We should absolutely avoid making submissive enquires from them especially on Radharani. What madness is that?
You goto a sahajiya-cum-mayavadi to ask questions about Radharani? What is this? Makes no sense.
Even with fellow iskcon members we generally avoid, not ban but generally avoid, the topics of the gopis or Radharani.
And some guru goes out of iskcon and sits on the floor, at the mayavadi-cum-sahajiya’s feet, inquires from him who’s seated on a chair, about “Radharani’s bhava” and the
person on the chair is not initiated into a bonafide sampradaya.
We are not calling Sacinandana Swami a sahajiya, etc.
We are just saying that he is the type of person who thinks that it is okay to make humble
inquiries about Radharani’s Bhava from Ramesh baba who is a confirmed sahajiya-cum-mayavadi who has no diskha or even a siksha guru from any of the 4 sampradayas.
Sacinandana Swami does not take Ramesh’s shelter alone. He takes about 10 disciples to Ramesh Baba and make them all sit at his feet and do so as well.
So, you please use your head and call Sacinandana Swami what you wish to.
The evidence is present in front of you.
I am also like Hridayananda Goswami you see, I too am in favor of treating you like an adult as HDG says we should do.
So here we are – not name calling but letting you be the adult and understand what is the reality of Sacinandana Swami your self.

One of his disciples told me that Bhanu-nandini consulted an American PR consultancy because of the website about “Mr. and Mrs. Sacinandana Swami”, they told her they could not do anything about it other than “drown out the negative with the positive”… Interestingly enough, it was her, the cause of the scandal, who consulted with the company; and still, she lives in the same house, accompanying him everywhere he goes.

Few Good Gurus of Iskcon

Iskcon is the planet’s only school of unalloyed Krishna-Bhakti. When in iskcon take shelter solely of these great souls because only they broadcast Prabhupada’s unalloyed and unfiltered teachings. They are not feminists like almost all of the GBC members nor do the have any illicit relations with some young girl like Sacinandana Swami has. Sorry if your imagined paramhamsa pure devotee guru did not make the list. But here’s a list of the only people that you should hear from unto if you are an iskcon member and you are safe to hear all their lectures, kirtans, give em donations, etc.

If you don’t find someone on this list then I am holding my scriptural analysis on them because I’ve been given contradicting reports about them or I have too lil info on em to make a public statement or I have honestly never heard of them.

Sivaram Maharaj should note that varna ashrama does not stop at purchasing a big farm to grow organic carrots on and milking a few non-gen-mod cows and living away from the city. All brothels in Nevada are away from cities and are placed in the quite dusty Nevada country side. Are they varna ashrama institutes meant for taking souls back to Krishna?

Varna ashrama means values. It has strict rules that separate women and men. Maharaj is allowing this woman to sing like this in front of men and on top he is happily singing along with her. This is insult to injury. When the audience consists of both males and females it is not conducive to the chastity or shyness of women if they are made to sing.

For women to sing in front of men is a shameless act, for men to hear her is a shameless act and the worst of shameless acts is to justify these shameless acts using ‘Prabhupada said’. Of course, for the shameless what is the meaning of the word
‘chastity’ or ‘brahmacharya’? Varna ashrama, which Prabhupada ordered we follow, has many restrictions on mixing of men and women which our fellow iskcon members’ modern yavana sensibilities find irritating.

You want your sister or daughter to be put on display like this?

Do you want your son or nephew to be hearing a woman sing?

How will it promote brahmacharya in your son?

How will the shyness and dignity of your daughter be maintained when a room full of men scan her body all in the name of Harinam Sankirtana?

What should be done by the men as they hear this kirtan? Should men close their eyes and listen to the woman’s kirtan?

Thus it is unfair to the men in the audience and to the woman who is singing on stage.

Iskcon Diksha Guru & Tridandi Sannyassi of the Brama
Sampradaya His Holiness Sivaram Swami Maharaj has failed to understand this and
has promoted this unchaste behavior by his presence and participation in the
kirtan. If he was not able to stop it then he should have spoken something
against it and or at least walked away from the site. But him lending his voice
in the chorus is adding insult to injury.

Whose fault is it? Sivarama Maharaja’s or Harrison’s?

Women are less intelligent. Men not. So if a woman asks for poison and if the man gives it, who is at fault? Not the woman. So it is Sivarama Maharaj’s fault here.

FYI, the woman singer is Jhanavi Harrison, the daughter of Kripamoya Das. He is a Prabhupada disciple, iskcon diksha guru and a very important leader in Iskcon England and also (atleast in this matter) ignorant of vedic culture. He has another daughter Tulsi Nadia Sutaria who acts similarly but is not as famous as her sister.

Of all the women Sivaram Maharaj could pick to sing along, he picked Jhanavi, she sings along with sexual deviated mayavadis-cum-sahajiyas such as Wah!, Jai Uttal, Krishna Das and iskcon’s inhouse sahajiyas the Mayapuris.

  1. But the girl is singing the Hare Krsna Mahamantra, so it’s spiritual, it must be ok for men to hear and see her sing?
  2. So there are two things in her songs: a) the mahamantra b) the female voice, (a man is not allowed to hear a woman sing)
    You are not on the platform of going beyond the material side of spiritual objects and experiencing only the spiritual potency.
    E.g. If you constantly eat a lot of sweet prasadam you will get caries and diabetes because there is a material side to prasadam and you are not on the level of a pure devotee that you only partake in the spiritual side of prasadam. It is not that the prasadam will magically protect your teeth and will magically make your body release insulin in its blood stream to compensate for the increased sugar levels. This won’t happen.
    E.g. If the singer is not having a good voice you wont like the chanting of Krishna’s because you are still having the tendency to enjoy “good music” and a “good voice”. You are not perfectly and fully taking and tasting only the spiritual side of the chanting of Krishna’s names you are also enjoying the material side of things.
    These are simple things to understand. Only a complete moron(as Hridayananda Maharaj likes to call iskcon people) or a cheater would deny these facts.
    Even if you are a paramhamsa(an absolutely great devotee of Krishna), you are not to act on it, at least in public. Which Sivaram Maharaj himself teaches us in the ‘Calling women Prabhu’ audio blog
  3. It’s ok, she is singing in front of new comers?
  4. Iskcon is supposed to maintain high standards for the new comers to see. Any sane gentleman, from any race will appreciate this. What is the first impression that a new woman gets when she comes to iskcon? That it is ok to sing in front of men.

Prabhupada in the beginning did encourage women to have an outgoing role but he later ordered to instill varna ashrama norms seeing the high rate of fall downs in iskcon and relying on eternal vaishnava teachings. All the women who Prabhupada encouraged, we will not mention names here, are currently divorced or are on their second or third marriage. In vedic culture or varna ashrama a woman has her place as a teacher. She is the teacher of her male children when they are in the house upto the age of 5. So she does teach men upto the age of 5.
For the female children, the mother can be a lifelong teacher, she can teach them many things including Prabhupada’s books.
But now to take that to the public space, in a modern western way by making her a college teacher – this is not vedic culture, this is not in pursuance of the rules of varna ashrama.
A woman is supposed to be chaste and shy.
How will she be chaste if the male students look at her face for a 40 minute lecture day in and day out?
How will she be shy if she has to look the male students and speak in that lecture?
Thus this is a contradiction of the laws of varna ashrama which Prabhupada said we must instill in iskcon and subsequently throughout the rest of the world, calling it his ‘50% of the remaining task’.

Solution for Sivaram Maharaj:

There is no solution. You can’t change him if Krishna willing he changes he will. You can respectfully avoid funding him till the time he recovers from his current position of promoting anti-cultural values. He is on the whole a good guru and much better in many vedic aspects compared to Hridayananda Maharaj or someone else. (Respectfully: Since he is not a full feminist like Anuttama or Malati or Kaunteya, etc)

Hare Krsna. Having always trusted you because of your sensible, intelligent, and dispassionate Krsna consciousness, I also appreciate your concern regarding the present state of the SAC. I would like to ask a favor. Despite several months of questioning the SAC chair [Yadunandana Swami] and secretary [Madana Mohana Das] about the ways in which its recent FDG paper was mishandled, I have not received clear, relevant, timely, and accurate explanations from them. Neither has anyone from the EC replied to the (below) list of concerns, which I shared with EC beginning on 31/12/13. I had also asked SAC members (on 8/1/14) to share it with the larger GBC body; SAC has not complied.

Thus, I now feel it optimal—and my moral obligation—to inform the GBC myself, since the GBC has to be informed of SAC wrongdoings. Any decisions following from such tainted papers are likewise tainted.

I know you had previously expressed concerns about both the SAC constituence as well as its most recent paper, and as a GBC member, you can post the concerns I’ve listed below to the GBC conference. If you would, kindly do so now. I apologize if this creates any botheration for you; I only hope my input helps you all to make adequately informed decisions regarding both the SAC generally, as well as its last FDG paper too.

These concerns should be shared among the entire GBC body:

Over the last year, I (Mukunda Datta dasa) have lost faith in the current SAC led by chairman Yadunandana Swami and secretary Madanamohana prabhu, who fail to answer the substance of my questions about why my input was excluded from our recent paper on female diksa-gurus. This led to my withdrawing from the project (see below). Frankly, I sense the current SAC and its recent paper are both contaminated by partisan interests, partly because of the following:

1. Brijabasi Prabhu and I withdrew from the SAC paper only after we were denied our rightful—and any meaningful—voice within it.

2. Each of us separately identified various problems in the paper, but amidst suddenly imposed and restrictive conditions, a last minute SAC policy change (from consensus to majority rule) left us virtually no time to append any adequate response to the majority paper.

3. SAC leadership had significantly restricted both the scope and the objectivity of its FDG research from the very outset, while refusing to identify its de facto methodology when so requested.

4. Pre-existing SAC demographics were stacked so as to favor only one conclusion; I noticed a goal-oriented methodology operating by default—as if the outcome was considered a foregone conclusion, rendering SAC research but perfunctory.

5. Ultimately, no views questioning (nor research potentially jeopardizing) immediate FDG implementation were accommodated in the SAC paper. Secretary Madanamohana prabhu was supposed to have incorporated all members’ input, but all of his drafts of our paper either ignored or distorted virtually all of my input, which he hasn’t explained in substantial detail when asked to do so.

6. Of the four most senior SAC members, two are FDG candidates. Others ignored this conflict of interest when it was questioned early in our discussions. Among other qualities SAC members should demonstrate, the SAC mandate also explicates: “Apolitical” and “Not unduly ambitious for position or achievement, either socially, politically or academically.”

7. Madanamohana prabhu’s only complete draft of the paper wasn’t available for all SAC members themselves to read or edit as planned—until about 24 hours before its 1/10/13 submission deadline. Then SAC inclusion policy was suddenly changed to majority rule, thereby effectively sidelining any dissenting voices.

8. For what it is worth, since August 2013 I’ve had the impression that I haven’t been included in all consequential SAC discussions; however, this tangential suspicion is significant mainly because it coincides with so many validated concerns.

9. On 16/10/13, Yadunandana Swami explicitly stopped sending me SAC emails (citing my supposed breach of a confidentiality clause in the SAC mandate) after I shared my views in reply to a godbrother. My SAC email resumed weeks later (partially or not). When asked since October 2013 what specific allegations justified his action, he didn’t give all the pertinent details requested. Although he has since indicated his exact allegations, in context, his decision appears to have been ulterior, as it better matches a political motivation than my alleged breach of SAC confidentiality.

10. Especially amidst violation of its mandates against partisanship, to only enforce Yadunandana Swami’s interpretation of the SAC mandate on SAC confidentiality doubles as a virtual gag-order that effectively conceals genuine wrongdoings within SAC. Complying with it thus thrusts an unjust moral dilemma upon its victims, who must decide whether obedience is better than truth.

11. As my questions became increasingly pointed, Yadunandana Swami then announced his resignation from SAC, in a pre-planned decision he said was unrelated to the FDG project.

12. Notably, SAC secretary Madanamohana prabhu lately speaks (on 19/12/13) of disbanding SAC altogether, amidst various opinions from other SAC members in recent emails I’ve received.

13. I have not received substantial answers about my disfranchisement from either Yadunandana Swami or Madanamohana prabhu, despite my suggesting exactly how to clarify my concerns.

14. This (and more) seems to leave the SAC in a fairly doubtful state, with many unanswered yet crucial questions about its modus operandi. This is separate from issues about the specific content of its recent FDG paper—though it definitely impacts that as well.

Not at all confident that the recent SAC paper established a fair, objective, and carefully researched conclusion on all the topical questions we were assigned, I didn’t want my name associated with it–especially since I was tacitly denied a voice in it. SAC diligently suppressed both important questions and dissent in its consequently imbalanced and perhaps politically motivated paper. Given that my research was excluded amidst the above factors, to imply that I declined to sign the paper only because I felt a need for further research is misleading. Under the circumstances, it seems my duty to relate the truth of my firsthand experience within SAC to our authorities, as Yadunandana Swami recently advised me. I wrote the EC with essentially the above list on 31/12/13, but it has not replied, nor has anyone in SAC, since my 8/1/14 request that SAC members inform the GBC of these concerns.

One legitimately wonders how each SAC member can substantially contribute to SAC amidst what amounts to implicit censorship, if SAC protocol remains until it is alleged violated (and even then isn’t explicated in much detail), if it is moreover subject to sudden and drastic changes without notice, and if member participation requires bending truth to fit the majority opinion–as has now become the SAC policy.

I remain happy to participate in SAC, though I sense it could use more oversight or even reformation, in order to prevent future abuses.

The divorce act is encouraging prostitution, and this should be abolished. (SB 1.17.38) In Vedic civilization the husband and wife were not separated by such man-made laws as divorce. We should understand the necessity for maintaining family life in human society and should thus abolish this artificial law known as divorce. (SB 4.23.25)…there is no such thing as divorce in the Vedic literature. A wife is always trained to be chaste and faithful to her husband, for this helps her achieve deliverance from any abominable material condition (SB 9.20.22)

Generally, separation between husband and wife is due to womanly behavior; divorce takes place due to womanly weakness. The best course for a woman is to abide by the orders of her husband. That makes family life very peaceful. Sometimes there may be misunderstandings between husband and wife…but a wife should not leave her husband’s protection because of such misunderstanding. If she does so, it is understood to be due to her womanly weakness. (SB 4.4.3)

What is this nonsense, divorce? There is no such thing in the Vedic civilization, divorce. You must accept whatever God has given you as husband or wife, you must. They had no thinking even, idea of divorce. One may not agree with the husband.. That is natural. Sometimes we do not agree. But there is no question of divorce. In the modern day, the wife is never submissive, and therefore homelife is broken even by slight incidents. Either the wife or the husband may take advantage of the divorce laws. According to the Vedic law, however, there is no such thing as divorce laws, and a woman must be trained to be submissive to the will of her husband. Westerners contend that this is a slave mentality for the wife, but actually it is not; it is the tactic by which a woman can conquer the heart of her husband, however irritable or cruel he may be. (SB 9.3.10)

Generally, separation between husband and wife is due to womanly behavior; divorce takes place due to womanly weakness. The best course for a woman is to abide by the orders of her husband.

THIS SEPARATION AGREEMENT AND PROPERTY SETTLEMENT is made and entered into this 23 day of August, 1996, by and between HOWARD C. BEST of Orange County, North Carolina (thereinafter referred to as “Husband”) and EDITH E. BEST of Orange County, North Carolina (hereinafter referred to as “Wife”)

WITNESSETH:

THAT WHEREAS, Husband and Wife were lawfully married on October 12, 1973 and lived together as Husband and Wife until on or about the 8th day of April, 1996, at which time they separated one from the other, and intend to continuously live separate and apart: and
WHEREAS, because of unfortunate differences and incompatibilities which now exist between them, they are no longer able to live together in peace and harmony as husband and wife; and
WHERAS, Husband and Wife have had the opportunity to consult independently with attorneys of their choosing, respectively, concerning this Agreement, and both parties agree that it is entered into mutually of their own free will, and
WHEREAS, both parties stipulate that they have carefully read and understood the terms and conditions of their Agreement, and deem them to be fair, just, and equitable, and are in full and complete satisfaction of all claims, present or future, arising out of or in any manner related to their marriage; and
WHEREAS, each party warrants that he or she has disclosed to the other all assets in which he or she has an interest and all debts on which he or she is liable, in an amount in excess of @00;
NOW, THEREFORE, in consideration of the mutual covenants and agreements hereinafter set forth, Husband and Wife mutually covenant and agree as follows:
1. Separate Maintenance. The parties agree that hereafter each may at all times live separate and apart from the other, free from each other’s marital control and authority as if each were single and apart from the other, free from each other’s marital control and authority as if each were single and unmarried; may reside at such place or places and with such person or persons as each may desire; may conduct and engage in any employment, business, trade or profession each may desire, choose or deem fit, and to enjoy the benefits thereof.
2. Covenant of Non-interference. Husband and Wife hereby agree that neither of them will, in any manner, molest of interfere with the personal rights, liberties, privileges or affairs of the other. Each shall, henceforth, live his or her own personal life as he or she may see fit, unrestricted in any manner by the marriage and relationship previously existing between them.
3. Future Debts. From and after signing this Agreement, neither party shall charge, cause or permit to be charged to or against the other any purchase which either of them may hereafter make. Hereafter, neither party shall create any obligations in the name of or against the other, not secure or attempt to secure any credit upon or in connection with the other, or in his or her name. Each party shall promptly pay all debts and discharge all financial obligations which he or she may incur for himself or herself, and shall indemnify the other against any and all debts and all other obligations which he or she may incur for himself or herself.
4. Children. Of the marriage of the parties were both three children, Michael David, born November 9, 1974; Yamuna Devi-Dasi, born September 21, 1978; and Keshava Dasa, born July 14, 1981. Husband and Wife shall have joint legal custody of the minor children, Yamuna and Keshava, with Wife having primary physical custody. Husband shall have the right to visit with the minor children at any time that that is mutually convenient to the parties and upon the giving of reasonable notice to Wife. At such time as Husband is working and is able to afford paying child support to Wife on behalf of Keshava, he shall do so at the rate of $200.00 per month. If Husband is able to afford more than $200.00 per month then he agrees to pay Wife such additional amount as he is able to afford.
5. Division of Personal Property.
A. The parties hereto have previously divided the household furnishings and personal effects. All of the furnishings, equipment, and personal effects in the possession of the Wife and located at her residence (915 Dimmocks Mills Road, Hillsborough) shall be the sole and separate property of the Wife. Husband expressly acknowledges that he has no interest in any of the property and no desire to have as his own any of the property located in said residence. Any and all personal effects in the possession of the Husband shall be the sole and separate property of the Husband.
B. The Wife shall keep as her own funds any and all bank accounts she has in her sole and separate name. The husband shall have as his own funds any and all bank accounts he has in his name.
C. The parties agree that at the current time there is certain equipment located at Computer Network Solutions (owner Butch Flake) in Hillsborough. So long as Husband either takes such property into his possession or sells such property on or before September 30, 1996 then all such property and/or any and all proceeds from such property shall be his own and separate property. In the event, however, that Husband does not take such property into possession or sell such property on or before September 30, 1996 then, in that event, such property shall be considered marital property and Wife shall have the authority to take the property into her possession and the parties shall divide it between themselves as they may be able to agree between themselves; also, Wife shall have the authority to sell such property after September 30, 1996 at a reasonable price and she shall be obligated to hive to Husband one-half of any proceeds of such as sale.
D. The Wife shall have the 1987 Toyota Van as her sole and separate property.
6. Mutual Release. Except as expressly set forth herein, each party does hereby waive any and all rights- past, present, and future- which either party may have against the other for support, alimony, post-separation support, any claim under the Equitable Distribution Statutes, and all other claims which the parties may have by reason of the marriage. Wife waives any claim she may have against Husband for the support and living expenses of Husband’s son. Except as herein provided, each party may dispose of his or her property in any way and may convey any real property or any interest therein without the consent or joinder of the other party. Each party does hereby release and forever discharge the other, his or her heirs, executors, administrators, assigns, property and estate, from any and all rights, claims, demands and obligations of every kind and character for past and future support and maintenance, homestead rights, widow’s year’s allowance, rights of inheritance, dissent, and distribution and specifically relinquishes the right to act as executor or administrator of the estate of the other, rights of election against the Will of the other, and from all other rights, claims, demands and obligations of every kind and character arising out of or by virtue of the marital relationship of the parties, except as in this Agreement may be otherwise expressly provided. Each is forever barred from having or asserting any right, claim, demand or obligation at any time hereinafter for any purpose, except only things which may arise under this Agreement.
7. Act for Equitable Distribution of Marital Property. Husband and Wife are fully aware of the extent of assets titles to each other. Each party hereby waives and releases any and all rights they may have which may arise out of the enactment of North Carolina General Statues 50-20, more commonly known as the “Act for Equitable Distribution of Marital Property”, except as herein set out.
8. Enforcement of Agreement. The parties agree that, in the event either party fails to comply with any of the material provisions of this Agreement, the other party may seek legal counsel and may initiate an action in the District Court of North Carolina asking for specific performance, for damages, or for any other remedy available by law. The non-complying party shall be responsible to the other party for any and all expenses incurred by him or her therein, including a reasonable attorney’s fee.
9. Cooperation. The parties agree and understand that in the event of a sale, transfer, or conveyance of any property, whether real or personal, now owned or hereafter to be acquired by either of the parties hereto, it may become necessary in order to guarantee good title thereto, for the parties to this Agreement to execute the said deed, conveyance or bill of sale, conveying said property.
10. Agreement. This Agreement can be altered and amended only by further written agreement duly executed by the parties. Any failure by either party to specifically perform or enforce performance exactly according to the letter of this Agreement shall not constitute an alteration of the same by way enlargement, reduction, estoppel or otherwise, unless confirmed in writing by the parties, and duly executed by both parties except as may be otherwise provided above. It is understood that the parties may, by mutual agreement, make temporary modifications from time to time as conditions require, but this Agreement shall nonetheless be binding upon the parties as written, except in the event of a material breach.
11. Legal Counsel. Both parties acknowledge that they have had the opportunity to consult with an attorney of their own choosing. Husband acknowledges that Wife is represented by Attorney Mark T. Sheridan, Hillsborough, North Carolina, that Mr. Sheridan has drafted this document, and that he has not provided any advice to him. Husband further acknowledges that he has had the opportunity to consult with an attorney of his own choosing.
12. Entire Agreement. This Agreement contains the entire understanding of the parties. There are no representations, warranties, covenants, or undertakings other than those expressly set forth herein.
13. Situs. This Agreement shall be construed and governed in accordance with the laws of the State of North Carolina.
14. Binding Effect. Except as otherwise stated herein, all provisions of this Agreement shall be binding upon the respective heirs, next of kin, executors and administrators of the parties.
IN WITNESS WHEREOF, the parties hereto have hereunto set their hands and seals to the instrument executed in duplicate originals, all this day and year first above written.
